Taxation of Gibraltar non-resident companyThe most practical type of all offshore corporate entities available in Gibraltar is the non-resident company Gibraltar. The Gibraltar Companies (Taxation and Concessions) Ordinance of 1967 provides for two other specialised tax-efficient corporate structures in Gibraltar - the exempt company and the qualifying company. However the future status of these two offshore company types is unclear and quite possibly they will be gradually phased out in foreseeable future, following a policy of streamlining of the Gibraltar offshore regulations. This, however, does not concern the non-resident company Gibraltar.As to the peculiarities of company setting Gibraltar, non-resident company Gibraltar has been long recognised as an excellent alternative to the Irish non-resident company which itself was very popular as offshore vehicle until 1999. As a matter of fact, many of the Irish non-resident companies have since been re-domiciled to Gibraltar. The non-resident company Gibraltar is also in many ways similar to the pre-1988 non-resident company of the UK. Concerning Gibraltar tax system, in order not to be taxable in Gibraltar, a Gibraltar-registered company has to satisfy the following criteria: 1. It must be owned by persons, who are not resident in Gibraltar. 2. It must be controlled (directed) by persons who are not resident in Gibraltar. 3. It must not trade in Gibraltar. 4. It must not remit income to Gibraltar. If the above four criteria are satisfied, a company, which is the subject of Gibraltar incorporation, will be considered "non-resident". As such, it will not fall under the Gibraltar tax system by definition and will not be required to register for Gibraltar taxation purposes.
